Nowadays, the USA is globally recognized as a democratic country that promotes equality for all its citizens and ensures their safety and prosperity through all measures available. However, in the past this country faced several critical challenges that undermined democratic principles and foundations of a liberal society governed by equality and respect. Thus, one of these challenges concerned employment discrimination on the basis of various factors like age, sex, race, nationality, ethnicity, religion, etc. This problem was quite topical at those times as thousands of hundreds of people were deprived of an opportunity to get a decent job and earn a living. Therefore, the US government decided to solve this problem by adopting Title VII of the Civil Rights Act of 1964. Although this title has been amended by subsequently adopted acts, laws, and regulations, its underlying essence has remained the same, namely, it is aimed at ensuring equality in terms of employment and at eliminating all manifestations of employment discrimination based on race, age, religion, national origin, appearance, disability, and other aspects that may distinguish a person with respect to employers or the majority of the staff. Title VII is valid in the USA and is not enforceable with regard to foreign entities. All organizations and businesses carrying out their business activities in the USA or incorporated on the territory of the USA shall comply with its provisions. The law is enforced by the Equal Employment Opportunity Commission established in line with the Title VII. Title VII of the Civil Rights Act of 1964 seems to have virtually no impact on the planet in general in terms of all beings and the physical environment. However, it has a certain impact on human beings all over the world. The USA may be deemed a country that has set an example for the rest of the global community as countries should strive to achieve standards stipulated by the law in question. Nowadays, the world’s development is marked by a tendency towards globalization. Developing economies and the so-called Third World countries look at the Western world, especially the USA, in all respects. People from other countries see that the US citizens enjoy or are at least granted equal employment opportunities. Thus, when they compare their country with the USA they want employment discrimination in their own countries to be eliminated. Hence, they exert pressure and influence on their governments in order to ensure adoption of a similar regulation that would haul employment discrimination.
Title VII of the Civil Rights Act of 1964 is of utmost importance for the US society due to its positive effects on communities and organizations. Prior to its adoption, employers could discriminate people on the basis of their race, sex, religion, or any other factors and such behavior would have been considered as completely legal. Discriminative employers would not have faced any repercussions and the society accepted such state of affairs. Thus, entire groups of people were marginalized simply because they were unlucky enough to be born with a color of skin, for instance, that set them apart from the majority of the population. In turn, the representatives of the White community enjoyed a lot of benefits regarding employment and easily obtained jobs with high salaries and great prospects while actually performing only few duties. On the contrary, representatives of ethnic minorities, the African Americans in particular, and females were marginalized on the premise that they were not good enough for employment, hence automatically developing a stereotype that such people were disadvantaged in all respects and did not enjoy the same benefits as other members of their respective communities. At all times, employment has been crucial in determining a person`s place in the society in general and in their respective community in particular. Those people who could not find and retain good jobs with decent wages were subject to stereotyping as not clever or hard-working enough to be rejected by employers who as a rule occupied prominent positions in the society. Therefore, employment affects other domains of human life, being a determining factor in adult life, especially in industrialized democratic countries. It is believed that all members of the society are granted equal opportunities and that only their industriousness and intelligence can pave their way towards success and acknowledgement. The latter are in turn usually provided by employment. Thus, prior to enactment of Title VII of the Civil Rights Act of 1964 those members of the US society who were somehow different from the privileged groups of the population faced a vicious circle of discrimination in all spheres of their life. Lack of decent employment deprived them of an opportunity to receive quality healthcare and provide their children with decent schooling. Discrimination against various minorities was a serious problem that had a tremendous impact on all areas of human life, drawing an invisible, yet distinct, line between those who can have everything they want due to their birthright and those who cannot achieve anything despite their tremendous efforts and dedication. Adoption of the law that prohibited discrimination in regard to employment implied that the government was striving in earnest to eliminate manifestations of this adverse tendency in all spheres of life of the American nation. During the previous decades the government abolished slavery, provided females with voting rights, and strived to engrain democratic principles into the fiber of the American nation. However, all these efforts were significantly undermined by the lack of any regulation governing the scope of employment discrimination prior to the passing of the title in question.
